Who we are and these terms
"POM", "we" and "us" mean Peace of Mind Solutions Technologies LLC, which runs POM Studio and POM Networks from Deltona, Florida. Our mailing address is 3116 Covington Dr N, Deltona, FL 32738.
These terms apply to your use of pomnetworks.com (the website). By using the website you agree to them. If you don't agree, please don't use it. Work we do for you is agreed in a proposal or in writing, and these terms apply to it as described in Client work and agreements.
Using the website
You may use the website to learn about POM and to contact us. You agree not to:
- break the law or the rights of others;
- send us false or misleading information, or details that aren't yours to give;
- send spam, or use bots, scripts or other automated means to submit forms or to copy the website at scale;
- probe, overload or try to get around the website's security or its limits on how often forms can be sent; or
- interfere with how anyone else uses the website.
We may block access, or refuse a submission, that we believe breaks these terms.
Samples and illustrations
Projects and sites labelled as samples are made-up businesses that show the kind of work POM does. Device screens are illustrations; the car wash pay stations are client work.
What the website says about our services describes what POM does. It isn't a quote, an offer or a promise of any particular result, price or timeline. Work for you starts only when we agree it with you.
Our content and other people's names
The website's design, text, drawings, logo and other content belong to POM or its licensors. You may view it and share a link to it, but you may not copy, sell or reuse it without our written permission.
Names, logos and other marks of other companies, including clients whose work we show, belong to them.
Ubiquiti, UniFi, UniFi Protect, UniFi Access, and related product names are trademarks or registered trademarks of Ubiquiti Inc. in the United States and other countries. POM Networks is an independent installer and is not affiliated with, sponsored by, or endorsed by Ubiquiti Inc.
What you send us
When you send us an enquiry, you confirm that what you've given us is accurate and that you're entitled to give it. Sending an enquiry doesn't create a contract between you and POM, and we may decide not to take on a project. We use what you send as described in our Privacy policy.
Client work and agreements
Work we do for you is agreed in a written proposal that you sign electronically. A monthly plan is agreed in a proposal or in writing. These terms apply to that work and to your plan unless the proposal says otherwise. Your agreement is with Peace of Mind Solutions Technologies LLC, which runs POM Studio.
Your electronic signature on a proposal counts as a handwritten one, and the signed document and the record of the signing count as originals. We send proposals, invoices, receipts and payment reminders by email to the address you gave us. Tell us if it changes.
Projects: deposit and final invoice
A project has a deposit of 50% of the project price, due when you sign the proposal. We start work after the deposit is paid.
We invoice the rest of the price when we deliver the project. That invoice is due within 30 days of its date (Net 30).
Monthly plans
Monthly plans cover ongoing work, such as a design retainer, website care and hosting, or network and IT support. The price of your plan is the one agreed with you.
We invoice a monthly plan on the 1st of each month. The invoice is due by the due date shown on it, and we send automatic reminders (see Payments).
There is no minimum term. You can cancel at any time (see Cancelling a plan).
Design requests
- The number of design requests your plan includes each month is set in your plan.
- A request counts once, when we confirm that your plan covers it.
- Unused design requests carry over for one month only, and we use them first.
- When your plan ends, unused design requests end with it.
- Network and IT support requests don't count as design requests.
- If a request goes beyond what your plan includes, we send you a quote to approve first. We charge nothing for it without your OK.
- We may decline a request or re-scope it.
Payments
You can pay by card, including Apple Pay and Google Pay where the payment page offers them, or by bank transfer (ACH). Stripe processes the payments. We never store your full card or bank account number (see our Privacy policy).
Prices are as shown on your proposal or invoice. We send automatic reminders before and after an invoice's due date. We don't charge late fees.
Charges appear on your card or bank statement as POM STUDIO.
Automatic payments
Automatic payments are optional and start only if you ask for them. If you ask, Stripe saves the card or bank account you use to pay your first invoice, and we charge it on the due date of each invoice. We email you before each automatic charge.
You can turn automatic payments off at any time by contacting us at least 3 business days before the due date. A request made later may not take effect before the next charge. After you turn them off, you pay each invoice yourself.
Bank transfer (ACH) authorization
If you pay by bank transfer (ACH), you authorize us, through Stripe, to debit the bank account you link for the amount of that invoice. If you choose automatic payments with that account, you also authorize us to debit it for the amount of each invoice on its due date.
You can revoke this authorization by contacting us at least 3 business days before the due date (see Automatic payments). Stripe also shows you its own authorization when you link your account.
If a debit fails or is returned, we retry it or send you a new invoice. We don't charge a fee for it. Your bank's own charges, if any, are between you and your bank.
Failed payments and unpaid invoices
If a payment doesn't go through, we email you, and you can pay the invoice again. We don't charge a fee for a failed payment.
If an invoice is more than 30 days past its due date, and we have sent you a reminder, we may pause your work and services until it is paid. We don't charge a fee for pausing or for starting again.
Cancelling a plan
There is no minimum term. To cancel a monthly plan, tell us by email or phone before the 1st of the month: email info@pomnetworks.com or call (833) 997-6213. The month you are in is still owed, and we don't bill the next month. Notice that reaches us on the 1st counts for the next month, so the invoice we issue that day is still owed and billing stops after that month.
Refunds and disputes
- Project deposit. Refundable if you cancel before work starts. Once work has started, it isn't refundable.
- Monthly fees. Not refunded once the month has started.
- Design requests. Unused design requests end when your plan ends.
Work starts when we begin on your project, and we tell you when that happens.
If you have a problem with a charge, please contact us before you file a dispute with your card issuer or bank, so we can sort it out with you.
Availability
We don't guarantee that the website will always be available, uninterrupted, secure or free of errors. We may change, suspend or remove any part of it, or any page, at any time without notice.
Other websites
The website links to other websites, such as social media profiles, and may load services from other companies. We don't control them and aren't responsible for them. Their own terms and privacy policies apply.
No warranty and limits on our liability
The website and everything on it are provided "as is" and "as available", without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose or non-infringement.
To the fullest extent the law allows, POM is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of or inability to use the website. Our total liability to you for anything arising from your use of the website is limited to the amount you paid us to use it, which is nothing, because the website is free to use.
Nothing in these terms limits a liability that the law doesn't allow to be limited, and some places don't allow some of these limits, so some of them may not apply to you. These limits apply to the website only. They don't change the terms of any work we agree to do for you.
Governing law
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules.
Changes to these terms
We may update these terms. The version and effective date at the top say which one you are reading, and any change in wording gets a new version. If you keep using the website after a change takes effect, you accept the new terms. Changes to the SMS Terms follow item 10 of the SMS Terms.
SMS Terms
POM Text Messaging Terms
By ticking an SMS box on our website, or by texting START to (833) 997-6213, you agree to these SMS Terms, our Terms of Service and our Privacy Policy. "POM", "we" and "us" mean Peace of Mind Solutions Technologies LLC, which runs POM Studio and POM Networks.
- What we text. Service texts answer your enquiry, confirm and remind you of appointments, and update you on projects and support requests. Marketing texts, only if you ticked that box, share occasional offers and tips, follow up on proposals we've sent you, and ask for a review after a job.
- How often. Service texts vary with your requests. Marketing texts are capped at 2 a month.
- Cost. We don't charge for texts. Message and data rates from your carrier may apply.
- Opting out. Reply STOP, END, CANCEL, UNSUBSCRIBE, QUIT, REVOKE or OPT OUT to any text, or tell us any other reasonable way (call, email or a reply in your own words). We confirm by text and then stop. Opting out of marketing doesn't stop service texts about work you've asked for unless you tell us to stop those too. Reply START to resubscribe.
- Help. Reply HELP, call or text (833) 997-6213, or email info@pomnetworks.com.
- Your number. You confirm that you're the subscriber of the mobile number you gave us, or have the subscriber's permission. Tell us if your number changes.
- Carriers. Carriers aren't liable for delayed or undelivered messages.
- Privacy. We use your number and SMS opt-in only to send the texts you agreed to and to respond to you. We share it only with the vendors that deliver our messages, such as our phone and customer-management providers. We don't share or sell mobile numbers, or SMS opt-in data and consent, with third parties or affiliates for marketing or promotional purposes. We may disclose information when the law requires it.
- Electronic record. By agreeing, you consent to our keeping an electronic record of your consent.
- Changes. We may update these SMS Terms; the version and date appear at the top of this page. If a change is material, we text you before it applies, and you can reply STOP.
